Who can sue

  • Domestic Partners
  • Children
  • Grandchildren (if the deceased person’s children are deceased)
  • Minors who relied on the victim for at least 50% of their support
  • Anyone else entitled to the victim’s assets

The scope of potential plaintiffs in a wrongful death case in Texas is far smaller. Under Chapter 71 of the Texas Civil Practice and Remedies Code, a wrongful death case may be filed by the Decedent’s surviving spouse,children, and parents. In some cases, an adopted child may also file a wrongful death claim if the adoption was legally and fully completed.Adoptive parents may also file a wrongful death claim for their adopted child.
